Nick Beachy represents businesses, investors, and executives in complex commercial disputes. He has experience litigating antitrust, energy, intellectual property, probate, securities, and corporate governance matters, including high-stakes cases in Texas, Delaware, New York, Minnesota, Colorado, and California.

Representative Matters

Target Corp., et al. v. Visa, Inc., et al.
Represented 17 major national retailers, including Target, Macy’s, Staples, Office Depot, and others, in antitrust actions against Visa and Mastercard alleging interchange-fee price fixing and other anticompetitive conduct. The cases sought more than $20 billion in damages and resolved shortly before a scheduled two-month federal trial in New York.

In the Matter of Merrill Lynch First Franklin Mortgage Loan Trust
As second chair trial counsel for TCW and PIMCO, obtained and achieved court approval of two RMBS settlements totaling $250 million. In June and October 2023, Nick presented and cross‑examined RMBS experts at two contested settlement approval trials in Ramsey County, Minnesota. Both trial courts ruled in favor of PIMCO and TCW.

EnVen Energy Corp. v. Dunwoody
Represented David Dunwoody, co-founder and former president of EnVen, in a breach of fiduciary suit brought by his former company. The case was tried before the Delaware Chancery Court in July 2023, where Nick cross‑examined an EnVen employee on procurement and supply chain issues. After receiving the Chancellor’s post‑trial remarks, EnVen dismissed its claims against Dunwoody with prejudice. 

SitePro v. WaterBridge Resources LLC
Represented WaterBridge, a saltwater disposal company, in defense of a complex intellectual property case brought by a former vendor. After WaterBridge dropped plaintiff SitePro as its industrial automation and control vendor in favor of an in-house system, SitePro launched a sprawling lawsuit that included patent, trade secret, trademark, Computer Fraud and Abuse Act, breach of contract, and other theories. Nick took key fact witness depositions, including SitePro executives and salespeople. After fact discovery, the matter settled on confidential terms.

Wiwynn Corporation v. X Corp.
Represented X Corp. in a dispute with a server manufacturer during key discovery phases, including deposing adverse witnesses in Taiwan. Wiwynn settled its claims after fact discovery.

In Re: Estate of Linda Sykes Bryant, Deceased v. Carlton Energy Group, LLC, et al.
Represented defendants in a high-stakes business ownership dispute brought in probate court. The estate of a former Carlton Energy Group employee alleged a 20% interest in the company and sought over than $50 million in member distributions. The matter was resolved through a confidential settlement before trial.

Box Elder Kids, LLC, et al. v. Anadarko E & P Onshore, LLC, et al.
Represented Anadarko in litigation originally filed as a putative class action on behalf of thousands of parties to Surface Owner Agreements, alleging that Anadarko improperly changed its payment methodology in 2010. Following discovery and extensive briefing, Anadarko successfully defeated class certification. After additional discovery, the individual plaintiffs’ claims were settled on confidential terms.
