Trial Court Entered a Take-Nothing Judgment

The firm was lead counsel for the Defendant in royalty suit alleging underpayment of royalties, fraud, breach of fiduciary duty, and negligent misrepresentation.  Pre-trial damages claims exceeded $400 million; demand at trial exceeded $61 million.  The jury found that Plaintiffs were barred from pursuing their claims and that Plaintiffs’ damages were less than $150,000.  Based on the jury verdict, the trial court entered a take-nothing judgment and entered a declaratory judgment on Defendants’ behalf barring future claims.  Judgment was affirmed on appeal by the U.S. Fifth Circuit Court of Appeals.
