Prosecuting $1.6 billion in securities fraud claims on behalf of 26 groups of institutional investors against accountants, trustees, and investment banks involved in the issuance of the debt securities of National Century Financial Enterprises.

Former Outside Directors of Enron
Representation of the Outside Directors of Enron's Board in over 100 cases and related federal, state, and administrative investigations that arose from Enron's collapse. The firm’s clients cooperated fully with respect to all requests for testimony from enforcement personnel and criminal prosecutors, and were not charged with any criminal or regulatory violations of the securities laws.

Former Directors of Peregrine Systems, Inc.
Represented certain former directors in a suit in which the plaintiff, a litigation trust formed in the bankruptcy of Peregrine Systems, challenged over $500,000,000 in stock sales by Peregrine’s board and management and sought treble damages of a billion and a half dollars under a California insider trading statute. Also represented former directors in connection with various litigation brought by certain shareholders including California state litigation in which summary judgment on behalf our client was achieved. This ruling was successfully defended, after briefing and argument, on appeal.

City of Houston
Pro bono defense of the City of Houston in its effort to abate air pollution within the City. The City is opposite the BCCA Appeal Group, a non-profit entity backed by powerful industrial players, which has alleged the City’s ordinance is unconstitutional. Case is pending.

Doosan Heavy Industries & Construction Company
Represented one of South Korea’s largest construction companies in a suit in which ExxonMobil and Fluor Daniel alleged faulty construction of pressure vessels intended for use at Exxon’s hydro-desulfurization refineries in Texas and Louisiana. The case settled favourably after we obtained summary judgment against Exxon’s tort claims, and demonstrated a strong defense to its contract damage claims.

City of Houston 
Defense of the City of Houston in a lawsuit brought by Southern Crushed Concrete (SCC) challenging the constitutionality of the City’s Concrete Crushing Site Ordinance.  In October 2009, the court issued an order and final judgment granting the City’s motion for summary judgment, denying SCC’s motion for summary judgment, and dismissing SCC's claims with prejudice.  We vigorously defended the trial court’s ruling on appeal by SCC to the Houston Court of Appeals, which upheld the constitutionality of the City’s ordinance in November 2010.
